The Electronic Registry of this Ministry allows for the reception and sending of requests, and written communications relating to its scope, in accordance with the provisions of Law 39/2015, of 1 October, on the Common Administrative Procedure of the Public Administrations and Law 40/2015, of 1 October, on the Legal Regime of the Public Sector.

This Electronic Register was created and is regulated by Order HAP/547/2013, of 2 April.

The Electronic Register of this Ministry will be the only one used for all Department bodies. Its scope does not encompass the State Tax Administration Agency or other Ministry-dependent or attached public bodies that do not enter the Agreement with the Subsecretariat of the Department. In this regard, and according to that stipulated in Article 1.2 of the aforementioned Order HAP/547/2013, of 2 April, the public bodies below are deemed subject to the Online Registry once the corresponding Agreements are signed: State Vehicle Fleet, Institute for Fiscal Studies, and Commissioner for the Tobacco Market.

Electronic identification and signature:

Those interested may identify themselves through the Electronic Registry and sign, where necessary using the related identification and signature systems detailed in Articles 9 and 10 of Law 39/2015, of 1 October.

In general, to complete any action covered under an administrative process, it shall be sufficient that interested parties prove their identification through the forms of identification detailed in Article 9 of said law.

The Public Administrations shall only require the obligatory use of the signature on the part of interested parties with those systems listed in Article 10 of Law 39/2015, of 1 October, in order to:

  • Submit requests
  • Present responsible declarations or communications
  • Bring actions
  • Withdraw actions
  • Waive rights

The application in support of each of the electronic procedures or services shall verify the systems of identification and signature permitted.

Acknowledgement of receipt:

The Electronic Register will issue automatically by the same means an electronically signed receipt with the following contents:

  • The individualized registration number or code
  • Date and time of submission
  • Copy of the statement, communication or application submitted, verbatim reproduction of the data entered in the presentation form being acceptable for these purposes.
  • When applicable, the list and name of the documents attached to the submission form or document submitted, followed by the electronic imprint of each one of them. For these purposes electronic imprint is taken to be the summary that is obtained as a result of applying a mathematical compression or hash algorithm to the information in question. The acknowledgement of receipt will quote the algorithm used in the preparation of the electronic imprint.
  • When it is a case of statements instituting a proceeding, the information both on the maximum time limit specified in the regulations for the resolution and notification of the proceeding and on the effects that may be produced by administrative silence, when automatically determinable.
